Joe Biden has lost two court cases in a row trying to defend his repugnant federal vaccine mandate. A District Court judge said that the mandate was illegal last year, and the Fifth Circuit Court of Appeals just agreed.

Biden issued an executive order back in September of 2021, declaring that 4.2 million federal employees were required to stick something in their bodies if they wanted to keep their jobs. Sounds kind of icky when we phrase it like that, doesn’t it? Well, sorry. That’s what vaccine mandates are – a form of medical rape.
A nonprofit called Feds for Medical Freedom sued the Biden regime on behalf of about 6,000 federal employees from all 50 states. Biden claimed at the time of the executive order signing that he had the authority to stick anything he wants into the bodies of federal employees, under the Civil Service Reform Act (CSRA). He said the CSRA gave him authority to set “workplace conditions” for employees. He also claimed that Article II of the Constitution gives him absolute authority to jab something into the bodies of federal employees if he wants to.
Okay, we’ll stop with the rape analogies. But you get the point. Joe Biden didn’t want anyone to not get the shot, and if he could coerce them over fear of losing their jobs, then that would be awesome for him. Democrats get a passionate thrill from bossing people around and humiliating them.
When the case was heard by Judge Jeffrey Brown at the US District Court for the Southern District of Texas, he issued a nationwide injunction against Biden’s unconstitutional, illegal, and morally repugnant vaccine mandate.
When Biden appealed, the case was initially heard by a three-judge panel of liberals at the Fifth Circuit, which overturned the injunction. But then the entire court heard the case en banc, and that resulted in the 10-6 vote that has now put the ban on Joe Biden’s vaccine mandate back in place.
Joe Biden’s only hope at this point is to appeal it to the Supreme Court, and it’s unclear whether they’ll look at the case or let the Fifth Circuit’s injunction stay in place.
In the 10-judge victory decision, they wrote that they “substantially agree” with Judge Jeffrey Brown’s decision. The decision noted that the CSRA “authorizes the President to regulate the workplace conduct of executive-branch employees, but not their conduct in general.”
Therefore, the court reasoned, Joe Biden doesn’t have any authority under the CSRA to make a vaccine mandatory. The judges also rejected the claims that Article II authorizes Joe Biden to force vaccinate federal employees. The Biden regime’s attorneys could not point to a single instance throughout American history in which the head of the Executive branch had mandated a medical procedure as a condition of employment.
The judges did seem to argue in the decision over whether the CSRA is even legal in the first place. One of the implications of their decision, they acknowledged, is that presidents don’t have the authority to fire federal employees at will. While that’s a real problem, and one that Donald Trump plans to correct in painful fashion for the Deep State after he’s reelected, that wasn’t what the Fifth Circuit was ultimately deciding.
So, what’s next? The case now gets kicked back to Judge Brown in Texas. Lawyers will argue over whether the judge’s injunction should just apply to the 6,000 federal employees who stood up for their medical freedom by suing Joe Biden, or whether the injunction will apply to all federal employees.
It’s too bad that so many federal employees were scared and coerced into taking the vaccine, even though they had doubts about its safety and efficacy. Joe Biden coerced them into taking a shot they didn’t want, and many of them were harmed. They should have stood their ground like these 6,000 brave individuals.

Hopefully, we’ll see more appellate rulings like this one. It suggests a reduction of what is and what is not government business. Clearly, the federal government has increased its authority over issues never intended to be the business of government.
Even the CDC (Centers for Disease Control and Prevention) has comprehensive rules that govern what it must prove before “mandating” any procedure or treatment. Normally, medical procedures are private matters between patient and physician.
