Manhattan District Attorney Alvin Bragg, who is financed by George Soros and who is also fat, deserves to be arrested. While arresting Bragg for prosecutorial abuse of President Donald Trump seems perfectly reasonable to most normal people, very few Members of Congress have been willing to say that out loud.
But Rep. Marjorie Taylor Greene (R-GA) totally went there during the Trump rally in Waco, TX on Saturday. That makes her only the second Member of Congress to say what the rest of us are thinking out loud.
Bragg’s case against Trump completely fell apart last week, and now he’s trying to salvage something from the wreckage so he can still bring an indictment. Bragg called the former publisher of the National Enquirer, a man named David Pecker, in to testify before his grand jury on Monday. It’s unclear why he brought Pecker back in, since Bragg already had him testify back in January.
Bragg has totally thumbed his nose at the House Judiciary Committee, which called him in to testify about how he’s abusing the legal process. That was enough to make Marjorie Taylor Greene (“Notorious MTG”) take aim at Bragg on Saturday. She told the folks at the Waco rally:
“He (Bragg) should be arrested. You want to know why? We have to stop allowing Democrats to abuse us. It’s like we are a beaten spouse. We need to stand up to the abuse because they are the ones committing crimes.”
Senator Rand Paul (R-KY) was the first to call for Bragg to be jailed last week. By the way, we hope Sen. Paul’s aide who got stabbed in broad daylight in Washington, DC a few days ago is okay. Great job with that whole “defund the police” thing, Democrats!
It may sound strange to our modern ears, since it hasn’t happened in quite a while, but Congress absolutely has the authority to arrest people like Alvin Bragg. The House Judiciary Committee Republicans demanded that Bragg preserve all of his office’s communications, documents and testimony related to this abuse of power against President Trump.
Bragg responded to a lawful congressional oversight request by telling them to buzz off. He wrote back to the Judiciary Committee Republicans, “The letter only came after Donald Trump created a false expectation that he would be arrested the next day and his lawyers reportedly urged you to intervene. Neither fact is a legitimate basis for a congressional inquiry.”
Bragg is absolutely wrong. He’s a District Attorney. That’s a public service job that falls under “the judiciary.” And the House Judiciary Committee has authority to conduct oversight, even over a local prosecutor like him.
Plus, Alvin Bragg doesn’t get to determine what is a “legitimate basis for a congressional inquiry” or not. Congress can take care of that, but thanks anyway.
So, how does Alvin Bragg get arrested in this case?
He has failed to comply with a lawful inquiry from the United States Congress. When that happens, Congress has three options. They can make a criminal referral to the US Attorney for the District of Columbia and request that Bragg be arrested. (That won’t happen, since the current US Attorney there is a Biden appointee.) Congress could sue Alvin Bragg to try to have a judge compel his testimony, although that would likely take 30 years.
Or the Judiciary Committee Republicans can send the House Sergeant of Arms to arrest Alvin Bragg and throw him in a jail cell. When someone refuses to comply with a congressional inquiry or subpoena, one branch of Congress can hold a vote to hold that person in contempt. Once that happens, that branch of the Congress absolutely has the authority to arrest that person and throw them in a cell until they agree to testify. This hasn’t happened since the 1930s or so, but it has happened and it’s totally legal.
Democrats in the Senate wouldn’t be able to stop this process, if any House Republicans other than Marjorie Taylor Greene could find their spines and make it happen.
The Supreme Court ruled in 1821 that Congress has “inherent authority” to arrest a reluctant witness and hold them in jail to compel their testimony. It’s been done before. Here’s hoping it happens again real soon.
