President Trump has ordered that a new census be conducted immediately, and the illegal aliens be excluded from the nation’s official population count. If illegals were not counted for congressional apportionment, House Republicans would have as many as 30 additional seats right now. That would make it so much easier to save America from the radical communist Democrats. Plus, Americans in many states would finally have more proper representation in Congress.
Trump made the announcement on Truth Social:
“I have instructed our Department of Commerce to immediately begin work on a new and highly accurate CENSUS based on modern day facts and figures and, importantly, using the results and information gained from the Presidential Election of 2024. People who are in our Country illegally WILL NOT BE COUNTED IN THE CENSUS. Thank you for your attention to this matter!”
It’s about time!
Democrats, of course, are suddenly showing deep interest in the Constitution once again. That’s how you can always tell they’re lying. They don’t care what the Constitution says unless there’s a political angle they can use to their advantage.
Right now, they’re arguing that the Constitution says there’s to be a decennial census (every 10 years) to count the “whole number of persons” in the US. While that’s technically true, the Founding Fathers had no intention of stretching the definition of the “whole number of persons” to mean, “everyone from 190 countries who floods into America and demands welfare and voting rights.”
What they should have said was that the census will count the “whole number of persons who have allegiance to America.” This is something that was so obvious to the Founders on its face that they didn’t bother to explain it further.
Here is why President Trump is legally correct, and why illegal aliens have no right to congressional representation and should not count toward apportionment and electoral college votes.
The Indians.
It’s confusing for Americans today, but the Constitution references two designations for Native Americans at the time of the country’s founding: “Indians taxed” versus “Indians not taxed.” These two designations correspond perfectly with what we think of as legal versus illegal immigrants today.
“Indians taxed” were Natives who chose to live among the settlers in the original 13 colonies, rather than in tribal villages. They swore an oath of allegiance to the colonial governments, and they were subject to poll taxes. “Indians not taxed” lived in tribal villages, passionately hated the American settlers, and didn’t pay taxes.
There you go. “Indians taxed” were nearly identical to what we would think of as an engineer from a foreign country who comes here on a valid work visa. “Indians not taxed” were almost exactly like illegal aliens today, but with less child rape and cannibalism.
Beginning with the very first US census in 1890, “Indians not taxed” were not counted in the US census, despite being physically present in the original 13 states. It stayed that way until 1890, after the last of the Indian Wars against America had ended. If you didn’t pay taxes and had not sworn an oath of allegiance to the US government and our legal system, you didn’t count in the census.
Article I, Section 2, Clause 3 of the Constitution deals with congressional apportionment. This clause states that the number of all current and future House seats was to be determined by “the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed.”
Persons who do not pay taxes are not entitled to congressional representation. Even after the census started counting “Indians not taxed” in the 1890 census, they did not count toward congressional apportionment. And the “Indians not taxed” designation was reaffirmed by Congress in the 14th Amendment after the Civil War.
Illegal aliens today are conceptually no different than “Indians not taxed” in the 18th, 19th, and early 20th centuries. It is insane that blue states get more seats in Congress just because they have welcomed foreign invaders inside their boundaries. The illegals hate us, they only have allegiance to their home countries, and they don’t pay taxes. Plus, their treasonous employers hire them to dodge payroll taxes.
This is another bold move by President Trump, and it’s long overdue.
