The late Supreme Court Justice Ruth Bader Ginsburg was a progressive icon and diva to the political left in America. She was a fierce defender of killing babies and near the end of her life, she suffered from a toxic case of Trump Derangement Syndrome.
How ironic is it that one of the final Supreme Court decisions that she authored may prove to be the precedent that saves President Donald Trump from New York’s outlandish lawfare ruling against him last week?
Trump has appealed Judge Arthur Engoron’s $454 million fine for practicing legal real estate in New York. During a recent town hall, President Trump noted that he was appealing on the grounds that the unprecedented fine was a violation of the Eighth Amendment to the Bill of Rights:
“Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”
A $454 million fine for a quote-unquote “crime” in which there was no victim is definitely excessive. Not to mention a hot, steaming pile of bovine excrement.
We actually had a recent ruling in 2019 in which the Supreme Court came down against states imposing excessive fines on people. Ruth Bader Ginsburg authored that decision, and Trump’s appeal cites Ginsburg extensively. That case was Timbs v. Indiana.
An Indiana man named Tyson Timbs owed the state $10,000 in criminal fines that he had been unable or unwilling to pay. So, the State of Indiana attempted to confiscate his $42,000 Land Rover. On the surface, that was clearly an excessive fine because the vehicle was worth four times the amount of the monetary fine.
In authoring the majority opinion in Timbs’ favor, Ruth Bader Ginsburg wrote that the excessive fines clause in the Eighth Amendment applies to states under the Fourteenth Amendment’s due process clause.
“The prohibition embodied in the Excessive Fines Clause carries forward protections found in sources from Magna Carta to the English Bill of Rights to state constitutions from the colonial era to the present day,” wrote Ginsburg. “Protection against excessive fines has been a constant shield throughout Anglo-American history for good reason: Such fines undermine other liberties.”
In what could have been foreshadowing of this fake case against President Trump, Ginsburg noted, “They [excessive fines] can be used, e.g., to retaliate against or chill the speech of political enemies.”
That’s an exact description of the lawfare being used against President Trump. This has nothing to do with justice or the rule of law or “protecting our democracy.” They’ve literally had to make up fake crimes out of thin air just to be able to charge Donald Trump with something.
People forget, but back in 2016, WikiLeaks founder Julian Assange was still holed up in an embassy in London. ABC News was upset because WikiLeaks had published the emails from the DNC that were delivered to them by the late Seth Rich. They asked Julian Assange why he didn’t publish any dirt on Donald Trump. Assange replied that no such dirt existed. Donald Trump has always been one of the cleanest and most honest businessmen in America, not to mention a very stable genius.
There were no victims in this fake New York case. The banks were happy to have done business with Trump. They loaned him money and every penny was paid back. There were no victims. The Trump Organization used standard, everyday real estate pricing and negotiation methods in every real estate deal. No one lost money, no one was defrauded, and nobody got hurt.
Yet now New York Attorney General Letitia “I’m Actually Just Big-Boned” James is salivating at the thought of seizing skyscrapers that Trump owns. The whole thing is just obnoxious. We should brace ourselves for later this year, however.
President Trump is not going to get a fair trial in any of these venues. The only silver lining that we can predict at this point is that maybe—just maybe—the case in Georgia will be tossed out because of the unethical sexual antics of District Attorney Fani Willis, in which she personally profited at taxpayer expense for trying to prosecute Trump.
The Jack Smith case in DC and the Alvin Bragg case in New York are both going to result in convictions. Those will be defeated on appeal as well, but that takes time. In the meantime, it will be hilarious if Ruth Bader Ginsburg ends up getting Trump off the hook for this unjust fine in New York.
What has happened to the justice system in this country, when the judge can fine someone over 400 million dfollars when there were no victim, no crime, the banks were happy with the transaction and would be happy to do it again. This is unbelievable. What is happened to this country? It used to be one of the greatest countries in the world, now what is it? When the courts can fine someone 83 million when there is no evidence, when they can fine you over 400 million when there is no victim? I thought you had to have both to procecute someone. Other than this judges are turning loose criminals that have committed crimes where there are victims and more than enough evidence to put them in prison for years. This is crazy and getting worse by the day. How much longer can we last at the rate we are going? This country is going to hell. The third world countries are looking better all the time.
We are no better than a 3rd world country
Thanks to the Democrats
We are now living in a banana republic country.
Your absolutely correct
So True, James you are right on track. It is getting ridiculous!
Trump should have NEVER been fined in the first place, he should have never been in court! This is The Democrats way of keeping Trump from campaigning and away from politics altogether, since Democrats failed at having him removed. Three Democrat run states have removed Trump from their ballots, Colorado, Maine and now, Illinois. This will not fare well when The Supreme Court rules by June of this year, but Democrats will stop at nothing to have him disqualified, somehow? Makes you wonder who the real dictators are?
No I don’t wonder I know who the dictators are they are the ones that kept Trump from being president by a fraud election!terry
Very True, and we all see it now!!
Biden crime family, nothing to see here, not there there, but The Trump Family is crucified for nothing!
Agree
Now you can see how the schools are ruining children to be robots. Not taught right vs. wrong, personal accountability, respect for law, TRUE history, upholding our constitutional rights, responsible for oneself, God at the center of ALL things. Self, family, home, work…I don’t try to force my faith on anyone, just as I respect others right to believe as they wish. The left has gone so extreme that it’s starting to look like Europe around WWII. It’s past time to clean up D.C. and remove traitors and those unwilling to DO their sworn-oath jobs before we are overrun and it’s too late! They’re pushing fir crimes against humanity, that is NOT what GOD intended for us.
Did you see latest clip of Kamala speaking of the monies to be paid to students to “get out the vote”. That is clearly another way democrats will legally sign up millions. Of course that equally applies so WE CAN DO SAME.
Every single one of these actions against Trump need to be dismissed, down the toilet bowl from whence they should never return.
I totally agree with all the above statements. When crooked AG’s and crooked judges seem to take advantage of good people-well it is people like them who are destroying our once great nation. They should be disbarred and burn in hell, which is where they are headed. Anyone with half a brain can plainly see that the crooks are those corrupt Dumocrats.
The “justice” system is being used too often to accomplish objectives that have “0” to do with dispensing justice. It is obvious that some prosecutors and some judges are trying to achieve other objectives and ignoring “justice” . Those prosecutors and judges ought to face trials so that justice can be dispensed where it is required. The American public is being cheated and deprived of the American system of justice as originally conceived by our “Founding Fathers” by the political and personal considerations of such prosecutors and judges. And add in there with thsese thoughts the Democratic voters who will not even discuss the actions of such prosecutors or judges. They (in most cases that I personally know of) just refuse to even talk about the acts of the prosecutors, judges or Democrat legislators. I am disgusted with the current situation that has led to such injustice. Whether you like or hate Donald Trump you should consider the future of the U.S.A. and what is good and proper for the country. I hope that people who read my comment understand my point of view
Understand David, and totally agree with all of the comments here!!
There is one way to fix this DOJ and fix the border is elect Donald J Trump in 2024 and then the job is then in the right hands, greater economy , shut the borders and get our oil rigs drilling and pipe lines open and get energy dominant again JUST ELECT TRUMP and watch how things change for the better.
