Two House committees voted on Thursday to hold Attorney General Merrick Garland in Contempt of Congress. Garland has refused multiple subpoenas from Congress to deny them the ability to conduct oversight of the executive branch.
The move to hold him in contempt is largely toothless since our justice system is broken. Unlike ordinary Americans and especially Republicans, the corrupt DOJ is never going to willingly indict Garland for breaking the law.
However, there is one rare procedural move that could be used to have Biden’s Attorney General arrested—and one Member of Congress just invoked that rule.
Congress is not a law enforcement body, so it doesn’t have the authority to regularly arrest people. That falls under the Executive branch’s duties. But what do you do when you have the most corrupt Executive branch in American history?
The House Rules Manual has a provision that allows for the arrest and detainment of a person held in Contempt of Congress. It’s a maneuver that has been used historically to compel testimony or document production from government officials.
Former Obama Attorney General Eric Holder was held in contempt by Congress in 2012 over his refusal to turn over documents related to the illegal Operation Fast & Furious. That Obama-sanctioned crime resulted in hundreds of deaths around the world. This was back in my political consulting days, and I lobbied Republicans in Congress to invoke this procedural rule to have Eric Holder arrested.
They wimped out.
The average Democrat in Congress is willing to jam an icepick in your pancreas when you’re not looking, but back in those days, Republicans were complete and total wimps. Most still are, but there is a handful of MAGA conservatives in Congress today who are not sissies. One of them is Rep. Anna Paulina Luna (R-FL).
Rep. Luna told Merrick Garland to his face that she was invoking this procedural rule to have him arrested. In fact, she filed a privileged motion to do just that last week.
Luna’s motion gives the Department of Justice a swift deadline to indict Garland for his refusal to comply with congressional subpoenas. The deadline won’t go into effect until the moment that the full House votes to hold Garland in contempt. On Thursday, both the House Judiciary Committee and the House Oversight Committee voted to hold him in contempt.
The full Congress will likely hold Garland in contempt. Once that happens, the Department of Justice has 10 days to indict Merrick Garland. If the DOJ refuses to comply within that ten-day period, Luna’s privileged motion goes into effect.
The Speaker of the House can then direct the House Sergeant at Arms to put Merrick Garland in handcuffs and frog-march him to the House floor. The charges against Garland will then be read to him as he stands there in handcuffs. He will then be taken and locked in a jail cell until he chooses to comply with the subpoenas that he has violated.
Congress used to have a jail cell in the basement of the US Capitol for this purpose, but it’s long since been renovated into something else. Garland would presumably be held in a local DC jail – preferably the one where he’s holding the January 6 political prisoners. It would be nice for him to meet some of them in person (LOL!).
Whenever this tactic has been historically used, the perpetrator always caves very quickly. Bureaucrats like Merrick Garland aren’t exactly known for their courage. Most people agree to turn over the subpoenaed documents before the handcuffs are even put on them.
This is, however, a very real procedure that is still allowed under House rules. Keep in mind that the same Department of Justice that is going to predictably not indict Merrick Garland has sent senior Trump adviser Peter Navarro to prison for the same offense. Navarro refused to comply with a subpoena from the illegally constituted January 6 Liz Cheney committee. Steve Bannon is likely to go to prison for the same thing sometime later this year.
Why should Merrick Garland be allowed to break a law that former Trump officials are being jailed over?
The only potential wrinkle in this process is that the Speaker of the House has to order the House Sergeant of Arms to arrest Garland. That would require House Speaker Mike Johnson to not be a gigantic p*ssy for the first time in his tenure. That doesn’t inspire confidence, but we’ll see how it plays out.
And that my friends is the correct procedure by law. Deny a subpoena and expect cuffs and jail time. By True law Joe biden has No executive privileges. So he needs Subpoenaed. He committed Treason by calling for a surge of the border by illegal aliens. He committed Treason in bribery to remove a Ukraine official. Don’t try and conceal the Treason. In 2025 they will be accounted for by American Militia. The justice system is damaged almost beyond repair without a Civil War. And it will happen, and a lot of American Politicals will Pay the full price. So will the FBI, SO WILL THE WHO SO WILL THE WEF and plenty more of these fake government imposters who support the biden regime of Marxist, including BARRACK HUSEIN OBAMA’S communist, Democrat Party. And yes the MSM has set itself up to be wiped out completley. Soon it will be total conservative Media that reports true facts. Or else face Civil War. These are the ultimate facts.
Correct on everything I am taken back by all the Treason and he’s still in the White House, there is something seriously evil going on!
I would pay to see that.
Below is several ways to reach House Speaker Mike Johnson. Tell Him to Arrest Merrick Garland and lets get some teeth into the system. If enough respond to him as to our concerns and wishes, Most likely he will feel the pressure to arrest this thug. Thanks. Copy and pass on to your friends.
