The Supreme Court delivered one of its anticipated shockwave rulings on Friday morning that will have implications for hundreds of peaceful January 6 protesters and President Donald Trump. In a 6-3 decision, the court ruled that prosecutors and the DC Circuit Court had been misapplying the law by charging individuals with the Enron document-shredding statute.
More than 300 January 6ers have had their lives destroyed by this judicial malfeasance, and this could very well nullify two of the four charges that Donald Trump is facing in Washington, DC.
The Department of Justice was using 18 USC 1512(c)(2), commonly referred to as “obstruction of an official proceeding,” to add a felony charge to the cases of January 6 peaceful protesters.
This statute was written in the wake of the Enron scandal back in the early 2000s. When Congress wrote the law, it was intended to add stiffer penalties to white-collar criminals who shred documents that are under a DOJ or SEC subpoena (which was what Enron staffers did).
How a document-shredding law applies to people protesting at the Capitol is a mystery for the ages, but 18 district and circuit court judges in Washington, DC shamefully allowed prosecutors to get away with this charge. More than 100 January 6ers were held in pre-trial detention because they had been charged with this crime.
It’s a paperwork crime and not a violent crime that you would charge a terrorist with. Yet the January 6ers were treated as terrorists and held in prison for over a year, without trial, because of the 18 USC 1512(c)(2) charge.
A Trump supporter from Missouri was just sentenced last month to five years in prison for the document-shredding charge.
None of these people obstructed an official proceeding. At best, you could say they briefly interrupted a ceremonial proceeding in the US Senate because they were petitioning the government for a redress of grievances—a protected First Amendment action—because they were rightfully upset about the stolen 2020 election.
One of the January 6ers, Matthew Perna, committed suicide after he was charged with 18 USC 1512(c)(2). He couldn’t take the prospect of being sent to prison for several years just because he had peacefully walked into the Capitol for less than 20 minutes.
Leftists can’t say that this was a partisan decision by the Supreme Court. The majority were Chief Justice John Roberts, Samuel Alito, Clarence Thomas, Brett Kavanaugh, Neil Gorsuch… and Ketanji Brown Jackson. Amy Coney Barrett, in her quest to become the next Sandra Day O’Connor, sided with the Justices Kagan and Sotomayor.
Justice Jackson wrote that despite “the shocking circumstances involved in this case,” the lower courts couldn’t simply misapply the law in such a fashion. The Enron document-shredding law has literally nothing to do with anything that the January 6ers did.
It would be like catching someone jaywalking and tacking on a manslaughter charge. It doesn’t even make sense to charge any of the J6ers with 18 USC 1512(c)(2).
More than 110 January 6ers have already been sent to prison because of this statute. The others are still awaiting trial. After the Supreme Court ruling, the court systems in DC were flooded with hundreds of motions to either vacate the sentences of the prisoners or to drop the obstruction charge against them.
This case, known as Fischer v. United States, made it to the Supreme Court finally after Joseph Fischer refused to accept the charge as legitimate. On January 6, the Senate adjourned and left the building because they were all too cowardly to speak to the protesters.
One hour after the Senate had adjourned, Fischer walked in and back out of the building in less than four minutes. Since there was no Senate meeting taking place at the time, how could he have obstructed an official proceeding?
This is huge news for the 300+ January 6ers who are no longer felons. It’s good news for Donald Trump as well. His lawyers have filed a motion to dismiss the two obstruction charges against him.
Now we’re just waiting for the Supreme Court to hand down its decision on presidential immunity, which could vacate all of Jack Smith’s charges against Trump in Washington, DC, and in the Florida documents case. That decision will likely come sometime today or later this week.
