This… is amazing! As of this writing, 17 more states have joined Texas in its lawsuit against the fraudulent election results in Georgia, Pennsylvania, Wisconsin and Michigan. Time for a panic at the Democrats’ disco, baby! This case seemingly came out of nowhere, but we have a sneaking suspicion that President Trump knew about it all along. He’s remained incredibly calm throughout this ordeal that the cheating Democrats have put America through. But now, there’s a light at the end of the tunnel.
Texas Attorney General Ken Paxton filed the suit earlier this week. It uses simple and straightforward legal arguments, which is part of why the Supreme Court immediately placed it on the docket.
Here’s the list of legend states that have come forward with their Attorneys General to join Paxton:
Alabama, Arkansas, Florida, Indiana, Kansas, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Utah and West Virginia.
To the Republican-controlled legislatures in other states: What are you waiting for?! Come on, Idaho! Come on, Alaska! You guys don’t want to be loser states that didn’t have the courage to stand in the breach with President Trump, do you?
And it goes without saying, if you live in a red state that hasn’t joined this lawsuit yet, get on the phone with your governor’s office and your state Reps and Senators. Tell them to join the Texas election lawsuit!
After so many court losses in the past month, why did the Supreme Court suddenly decide to hear this one? It has to do with the nature of the case.
Rudy Giuliani and the rest of Trump’s legal team have been wisely attacking the election fraud at the state legislature level. The state legislatures, as well as district and appellate courts, will at least give them a hearing. But the US Supreme Court was never going to take up a case like Giuliani’s.
That’s because Giuliani’s case is a fact-finding case. The Supreme Court doesn’t do those. You’re never going to see the Supreme Court conduct a trial where they hear evidence from two sides to make a fact-based determination (which is what Giuliani’s case is). That’s not a slight toward Giuliani, Jenna Ellis, Sidney Powell or the rest of the champions fighting this fraud. It’s just the reality of the Supreme Court.
The US Supreme Court takes the kinds of cases where it can settle disputes of constitutional law between two parties. That is the reason why Nancy Pelosi is guzzling way more Chardonnay today than she was a few days ago. This Texas case is exactly the type of constitutional law case that Supreme Court Justices live for. You might daydream about your next vacation or your next fishing trip, but constitutional originalists like Clarence Thomas, Samuel Alito, Brett Kavanaugh, Neil Gorsuch and Amy Coney Barrett daydream about being able to settle major disputes of constitutional law between states. This is exactly the type of case that they believe they were born to decide!
The fact that there are now 18 states joined together in this effort sends an important message to the court: A huge number of Americans have no confidence that the election was conducted fairly in those swing states. Paxton’s suit basically says that the way that Georgia, Pennsylvania, Wisconsin and Michigan changed their election rules was unconstitutional, thereby depriving other states of a fair and honest presidential election. Their unconstitutional actions overturned the result of the election.
Only state legislatures are allowed to change state election laws. It says this plainly in Article II, Section 1 of the US Constitution. Courts have ruled consistently for more than 200 years that this is a plenary power granted only to the legislatures. But in 2020, Democrat governors and their appointed secretaries of state arbitrarily switched to mass mail-in voting. They used the coronavirus as their shield to try to get away with this.
See their problem? There is no arbitrary suspension of the Constitution for a public health emergency. Paxton is arguing very simply that they didn’t have the authority to do that, and therefore the election results in those states are null and void.
What happens next if the Supreme Court rules in favor of Texas and the other plaintiffs? If they toss out the electoral results in those four states, neither candidate would have a majority of 270 votes. That would kick the can down the street to Congress. Each state gets ONE vote, and since red states outnumber blue states…
So long as Republican state legislatures don’t chicken out when it comes time to cast that vote, President Donald Trump would be headed back to the White House for four more years. And if the court rules against Texas, there are still more options on the table.
Nice, cogent explanation. I would only add that those same ultra vires acts by non-legislative actors also violate those states’ constitution, as well. That’s the import of the PA case because it was their legislature that amended their election law. However, they amended it in a way that would have first required an amendment to their constitution.

Heard SCOTUS rejected Texas case. I believe that every state that believes fraud was committed, they should send their own case. The more cases pile in SCOTUS hopefully that will make them listen. In the primaries both my wife and I went to vote, we live in Indiana and you have to show legal id.
We both were told the same thing after showing id, we had voted absentee which of course we hadn’t. The lady at the desk crossed of the check mark showing absentee voting and we were allowed to vote.
After all this false voting we are learning about, I wonder if the DemoRats voted for everyone over a certain age and if you didn’t show to vote they got your vote. Or, could this have been a trail run on how they could cheat the system.

I refer to OJ Simpson we know he was guilty there was more than enough evidence to convict him but our country feared riots.. therefore Justice was not done.
