President Trump’s legal team has a motion pending with the federal Appeals court arguing that he enjoys presidential immunity from prosecution for official acts while in office, just as every previous president in American history has enjoyed. It’s not “one rule for Trump and one for everyone else.” DC Judge Tanya Chutkin ordered a stay in special prosecutor Jack Smith’s case until the immunity question can be settled by the appellate court, followed by the US Supreme Court. Smith brazenly violated Chutkan’s stay last month, and now Trump’s legal team is calling for Smith to be held in contempt of court!
In her stay order issued in early December, Chutkin was very clear. She wrote that Smith was to pause “any further proceedings that would move this case towards trial or impose additional burdens of litigation on defendant.”
That means, don’t do anything. Go make a sandwich. Binge-watch ‘The Office’ or something on Netflix. Hurry up and wait until the appellate court and the Supreme Court sort out the question of presidential immunity from prosecution. It was a really clear instruction. Issuing a ‘stay’ order means that the court has ordered Jack Smith to DO NOTHING until further notice.
What the stay order means, in effect, is that this trial might never take place. If the appellate court or the Supreme Court rule that Donald Trump should be treated exactly the same as all previous American presidents, the case is over, and it can’t go to trial. That decision would also nuke Smith’s classified documents case in Florida and Fanni Willis’ case in Georgia.
So, what did Jack Smith and his team do in response to the stay?
They filed 4,000 pages of “additional discovery” on December 17th, and then submitted an exhibit list to the court and Trump’s team on the 18th. On December 27th, Smith asked Judge Chutkan to dismiss certain evidence that he expects Trump’s team to try to use.
That’s the exact opposite of not moving the case towards trial or imposing additional burdens of litigation on President Trump, which is what Chutkan ordered.
Trump’s attorney John Lauro filed a 15-page response to all this, demanding that Chutkan reveal why Smith and his team have not been found in contempt or sanctioned monetarily for violating her order. Smith can’t dump 4,000 pages of documents in Trump’s lap after the judge orders him to stop litigating the case.
In the Thursday filing, Lauro declared that “The prosecutors repeatedly engaged in that exact conduct, disobeying the Stay Order at least three times in just two weeks.”
“The prosecutors have no justification for their misconduct,” the filing continues. “The stay order is clear, straightforward, and unambiguous. All substantive proceedings in this court are halted. Despite this clarity, the prosecutors began violating the stay almost immediately.”
President Trump and his campaign staff have taken to referring to Smith as “Deranged Jack Smith.” They’re not kidding. This guy has such a terrible case of Trump Derangement Syndrome that he could give Barbra Streisand a run for her money.
For example, here is one of the statement’s from Smith’s latest filing. He asserted to the court that this would happen if Donald Trump were reelected:
“The Nation would have no recourse to deter [President Trump] from inciting his supporters during a State of the Union address to kill opposing lawmakers… to ensure that he remains in office unlawfully.”
That’s the craziest thing I’ve ever read in a court filing. This guy sounds like he belongs in Ye Olde Lunatick Asylum. He appears to be a smearing-his-own-feces-on-the-wall nutburger.
Politico also said the quiet part out loud in an article about Smith’s team this week. If you swap out Jack Smith’s name with “Robert Mueller,” what you will find is that Smith’s ENTIRE team is made up of the exact same people who participated in the Mueller/Russia collusion witch hunt. It’s the exact same FBI agents and the exact same DOJ lawyers. Even Andrew Weissman and Mary McCord are acting in advisory positions for Smith’s team.
Trump isn’t kidding when he says this entire Jack Smith witch hunt is just a continuation of the Russia collusion hoax. It’s the exact same people trying to railroad him, years after the fact! It makes you wonder if Hillary Clinton is the one cracking the whip and keeping these DOJ hacks on track when it comes to persecuting Donald Trump.
Trump needs to file a suit against all these crooked lawyers and judges to recover the cost of all these fraudulant indictments they have filed against him. This has got to be costing him a small fortune.
