Supreme Court Smacks Down Anti-Gun Laws in Four More Blue States

After overturning New York’s draconian anti-concealed carry law on June 23, the Trump Supreme Court vacated four lower-court decisions that had safeguarded similar laws in blue states. California, New Jersey, Maryland and Hawaii will now have to go back to the drawing board and rewrite their gun statutes under a more constitutional framework.

The four states are throwing fits about this, but to hell with them. They just spent the last five decades telling us that abortion was “the law of the land” because of a liberal Supreme Court decision on an issue that’s not even in the Constitution. Our gun rights are in the Constitution, and the conservative court is giving those rights back to the people.

Here are the four cases the Supreme Court just vacated.

 

In Maryland, people have to seek a license, go through safety training, and be fingerprinted by the state in order to purchase a handgun. Maryland also bans the sale of semiautomatic rifles and magazines that hold more than 10 rounds. This was known as Maryland’s Firearms Safety Act of 2013. 25 states sued Maryland over the draconian rules. The Fourth Circuit Court of Appeals upheld the law in September, but the Supreme Court vacated it.

Maryland will have to go back to the drawing board now, although the state’s Attorney General has vowed to defy the Supreme Court, saying “Marylanders have a right to be protected from these dangerous weapons.” We’ll see how that works out for the AG.

In California, the state banned the sale of magazines that hold more than 10 rounds, and also allowed police to actively confiscate such magazines. The state was sued, and the Ninth Circuit Court of Appeals ruled that it was completely okey-doke to confiscate people’s firearms and ban magazines (effectively banning most firearms, and clearly infringing on the Second Amendment). The Supreme Court says that’s not okay.

New Jersey’s anti-gun law was similar to California’s, but far more draconian in terms of the punishments. 10-round magazines are banned and must be surrendered to law enforcement. The Association of New Jersey Rifle and Pistol Clubs sued the state. Violating the New Jersey law can result in a fine of $150,000 and ten years in prison. That’s for law-abiding people! The Third Circuit Court of Appeals ruled that this is perfectly fine. And the Supreme Court just swatted them down.

And finally, we come to Hawaii, which has the worst anti-gun laws in the entire country. Just check out this horse manure. First you have to get a license from the chief of police of the county you live in before you can purchase a firearm. You can only transport an unloaded firearm in Hawaii if it’s in a concealed container, and if you are driving to or from a gun repair shop, a police station, a hunting location, a gun range, or a licensed gun dealer. And you can only drive to and from those places from your home.

If you go to a gun range and then stop at a convenience store on the way home, you’d better not let the Hawaiian cops catch you, because you’re then going to prison. Oh, and licensed firearms are only allowed for use in target shooting or hunting in Hawaii.

It gets even worse when you consider Hawaii’s incredibly terrible concealed carry and open carry laws. To get a concealed carry license or an open carry license, you have to prove to the government that there’s a “reason to fear injury” to your person or property. Likewise, you can only be granted a carry permit “where the urgency or the need has been sufficiently indicated” and you are “engaged in the protection of life and property.”

You pretty much have to have a bad guy shooting at you before the state of Hawaii will consider granting you the right to carry a firearm openly or concealed. If you don’t believe us, guess how many carry permits Hawaii has granted between 2000 and 2020? Go ahead, guess.

Four. That’s FOUR (4). F-O-U-R four. Four permits in a 20-year span.

The Ninth Circuit Court of Appeals ruled that Hawaii’s anti-gun laws were perfectly fine in March of 2021. The Supreme Court swatted them down as well.

It’s been a really good couple of weeks for gun rights in America. So much winning!

  2. Hogan is a big RINO here in Maryland. Time to get rid of DemonRats and all RINOS. We want real people that will give us the right to the constitution.
